Terms & Conditions
1. Provider, Scope, and Service Model
These Terms apply to all digital advisory and itinerary review services offered through Inside Namibia and provided by Floegel Consulting LLC. We provide limited-scope informational and advisory services only. No broader service, deliverable, guarantee, or ongoing support obligation exists unless we expressly agree to it in writing.
2. Advisory Only β No Travel Agency, No Booking, No Representation
Inside Namibia is not acting as a travel agency, tour operator, booking intermediary, insurer, emergency service provider, legal advisor, or on-the-ground operator. We do not make bookings, enter contracts with third-party providers on your behalf, or represent you in dealings with airlines, lodges, car rental companies, activity providers, or any other third party unless we explicitly agree otherwise in writing.
3. Your Responsibility for Decisions and Verification
You remain solely responsible for all travel decisions, bookings, payments to third parties, insurance, route execution, safety decisions, visa and entry compliance, health precautions, provider terms, driving conditions, weather checks, opening times, and availability. You must independently verify all critical details before relying on any recommendation or acting on any itinerary idea.
4. No Guarantee, Warranty, or Promised Outcome
Our services are provided on a reasonable-efforts, informational basis. We do not guarantee accuracy, completeness, availability, suitability for a particular purpose, booking success, road conditions, safety outcomes, provider performance, uninterrupted travel, or any particular travel result. Any timelines, recommendations, or planning views are estimates and guidance only unless we explicitly state otherwise in writing.
5. Orders, Payment, and Start of Performance
A booking is only accepted once payment has been successfully completed and we are able to begin performance based on sufficient submitted information. We may delay the start of work until we receive the information we reasonably need. Unless otherwise stated in writing, fees are due upfront and are tied to the specific service scope purchased.
6. Scope Boundaries, Revisions, and Extra Work
The purchased service includes only the scope described on the relevant offer page. Follow-up clarification may be provided at our discretion within reasonable limits, but additional research, repeated revisions, materially expanded planning, longer itineraries, or new trip scenarios are outside scope and may require a new booking, surcharge, or upgrade.
7. Right to Refuse, Pause, or Limit Service
We may refuse, pause, or limit a job if the request is outside our scope, the submitted information is incomplete, the requested timeline is unrealistic, there is suspected misuse or abuse, or we determine that we cannot provide the service in a commercially reasonable manner. If we refuse before substantial performance begins, we may issue a full or partial refund at our discretion unless payment processor rules or mandatory law require a different handling.
8. No Voluntary Cancellation or Refund Rights Beyond Mandatory Law
Except where mandatory law requires otherwise, there is no voluntary right of cancellation, withdrawal, or refund once performance has begun or a paid advisory output has been delivered. If mandatory consumer law grants withdrawal rights for digital services, those rights apply only to the extent legally required and no broader contractual right is granted.
9. Intellectual Property and Permitted Use
Any review, written feedback, itinerary comments, call notes, framework, template, or advisory material we provide remains our intellectual property unless mandatory law states otherwise. You may use the purchased output for your own personal trip-planning purposes, but you may not republish, resell, redistribute, train other systems on it, or use it commercially without our prior written permission.
10. Third-Party Providers and External Information
Any third-party provider, route condition, lodge, activity, map estimate, border rule, park rule, weather condition, or safety context may change without notice. We are not responsible for the acts, omissions, pricing, availability, cancellations, failures, or accuracy of third-party providers or external information sources, even if we mention or recommend them.
11. Limitation of Liability
To the maximum extent permitted by law, Inside Namibia and Floegel Consulting LLC are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of enjoyment, loss of opportunity, missed bookings, extra travel costs, or losses arising from your travel decisions, third-party providers, delays, changed conditions, or reliance on our advisory output. Any liability that cannot legally be excluded is limited to the amount you paid for the specific service giving rise to the claim, except where mandatory law prohibits such limitation.
12. Governing Law and Mandatory Consumer Rights
These Terms are governed by the law applicable at the seat of Floegel Consulting LLC, including the law of the State of New Mexico where applicable, without giving effect to broader conflict-of-law principles, except to the extent mandatory consumer protection rules in your place of habitual residence cannot legally be excluded. No clause in these Terms grants you rights beyond those required by mandatory law.
13. Severability and Contact
If any part of these Terms is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. Questions about these Terms may be sent to hello@inside-namibia.travel.
